Draft EIA Regulations 2009


The new EIA regulations were promulgated because of interpretation problems with the old regulations and also because of the changing legal regime relating to mining and the environment. New laws under the NEMA suite such as the Waste Act and the Coastal Management Act needed to be included in the EIA process.

In summary, changes were made to the procedural requirements of the EIA process, some listed activities were removed completely, other listed activity threshold levels changed and a new listing 3 was created to deal with activities in protected and sensitive geographical areas. New definitions attempt to clarify previous uncertainties and the concept of upgrades and expansion of activities are changed and are now based on the extent or threshold of the upgrade or expansion.
